Dear Greater Houston Pastors and Referendum Supporters:
Here is the most recent update regarding our lawsuit against the City of Houston which is currently pending before the Fourteenth Court of Appeals in Houston.
According to our attorney Mr. Andy Taylor, “In order to qualify our Petition in time for the upcoming November 2015 election, we have to hurry. The first attempt to speed things up was when we filed an Emergency Motion for Expedited Briefing Schedule and Decision with the Fourteenth Court of Appeals on May 1, 2015. Unfortunately, the Court denied our request on May 13th. This means that the Court of Appeals will hear our case on a normal and routine (non-expedited) timetable, and we will not get a decision until later this year or even perhaps not until 2016. This timetable will not enable us to get on the November 2015 ballot. Our second attempt to speed things up is an Emergency Petition for Writ of Mandamus before the Texas Supreme Court. This matter is still pending, but we remain hopeful the Court will pay attention to the need for speed.
A third attempt that is currently being contemplated and drafted is a brand new Emergency Petition for Writ of Mandamus, which would be filed before the Houston Court of Appeals. Basically the argument is that we cannot get expedited relief through the ordinary appeal, which was filed on April 30, so we need extraordinary relief on a mandamus basis.”
Pastors, please remain prayerful and vigilant that God grants us extraordinary favor in the courts by approving the Emergency Petition and the outcome will be nothing short of a victory at the polls this November.
